焦作市引荐外来投资奖励办法

　　第一条 为进一步扩大开放，调动各方面人士招商引资的积极性，吸引更多的外来投资者来本市投资，加快本市经济社会发展步伐，制定本办法。

　　第二条 本办法所称的外来投资者是指境外和本市以外在本市投资的客商。

　　第三条 对外来投资者以直接投资和收购、兼并、参股、控股等形式参与本市经济发展和企业资产重组者视为外来投资。

　　第四条 凡国内外个人或组织（以下称引荐人）通过各种渠道向本市引荐外来投资项目并获得成功的，一律给予奖励（本市各级机关公职人员在职责范围内的招商引资不予奖励）。

　　第五条 引荐人必须提供外来投资者真实投资意向，促使外来投资项目获得成功。
引进项目成功的标准：
　　（一）在工商部门登记注册；
　　（二）已批准的合同章程中外来资金按期到位；
　　（三）项目进展必须达到下列要求：
　　　1、技改项目正式投产，新建工业项目完成首期工程投资的50%；
　　　2、城市基础设施项目，完成首期工程投资的40%；
　　　3、其他第三产业项目，全部建成开业；
　　　4、农业综合性项目投入运营。

　　第六条 奖励数额比例按以下规定执行：
　　（一）对引进的外资项目按外来注册资金实际到位部分的5‰计奖；对内资项目，按引进内资中资本金或固定资产投入部分的5‰计奖；房地产项目按引进资金1‰计奖。
　　（二）对引进世界500强跨国公司或引进特别鼓励的高科技产业及形成本市新的支柱产业项目按8‰计奖。
　　（三）以无形资产作价投入的，按正式合同规定的作价金额5‰奖励。
　　（四）对于盘活企业存量资产的项目，按盘活的存量资产折半与引进资金实际到位资金额合并计算兑现奖励。
　　（五）对引进无偿捐赠资金的，按引资额的5%奖励。

　　第七条 未经引荐人引荐，外来投资者直接来本市投资的，奖励资金直接奖予投资者。

　　第八条 引荐人的奖金，内资直接以人民币支付，外资按市人民政府批准奖励当日的国家外汇牌价折算人民币支付。

　　第九条 引荐项目初始，引荐人在市发展计划委员会领取并按要求填写《招商项目引荐人登记表》（开发区和县市区的项目在当地领表填写），并经受益人确认后交市发展计划委员会（开发区、县市区政府）存档。

　　第十条 对引荐成功的项目，由市人事局、计委、外经贸局、财政局、工商局等部门和有关专家参加的奖励评审委员会（开发区和县市区的项目由当地审核）对项目进展情况进行评审，并依据《招商项目引荐人登记表》，确认引荐人的资格。核定奖励标准后，统一报市人民政府批准。

　　第十一条 对引荐人的奖励资金由受益单位与受益地方的财政部门按比例共同支付；无法确定受益单位的，由当地财政部门负责支付。

　　第十二条 本办法执行中的具体问题由负责招商引资的工作机构解释。

　　第十三条 本办法自2003年5月1日起施行。

Encouragement Provisions for Introducing Investment

Article 1. In order to enlarge open policy further, mobilize the positivity of people to introduce investment, attract more investment and speedup the development of local economic society, the following preferential provisions are formulated particularly.
Article 2. The foreign investors here include the merchants overseas and domestic to invest in Jiaozuo.
Article 3. Merchants who participate in the economic development and enterprises’ assets recompose of Jiaozuo City by direct investment, purchase, annex, share etc are regards as foreign investors.
Article 4. Individuals and organizations from China and other countries (recommenders are called hereinafter) who succeed in attracting foreign investment projects will be awarded except officials’ responsibility to attract investment.
Article 5. Recommenders are needed to offer the true investment intent of the investor in order to make the investment projects succeed.
Success criterions of attracting projects:
Ⅰ. Been registration in industry & commercial department.
Ⅱ. Foreign capitals approved in contract are invested on time.
Ⅲ. Following requirements are needed for the projects:
ⅰ. Projects of technical reconstruction put into production, new-built industrial projects accomplish 50 percent capitals of the first period investments.
ⅱ. Projects of urban basic establishment accomplish 40 percent capitals of the first period investments.
ⅲ. Other tertiary industry projects are built and proctised.
ⅳ. Agricultural comprehensive projects begin to manage.
Article 6. Provisions for proportion of prize capitals:
Ⅰ. Five in a thousand of registered capitals will be prized for projects overseas; five in a thousand of capitals or fixed assets will be prized for domestic projects; one in a thousand of attracting capitals will be prized for real estate projects.
Ⅱ. Eight in a thousand will be prized for attracting world top 500 companies or high-tech industries for particular encouragement.
Ⅲ. Five in a thousand of evaluated sum according to the formal contract will be prized for immaterial property investment.
Ⅳ. Combination of half of remnant assets liquidized and actual attracting investment capitals will be accounted to award for liquidizing remnant assets projects.
Ⅴ. Five percent of attracting capitals will be prized for attracting donation money.
Article 7. Prize will be awarded to the investors for direct invest in Jiaozuo without recommenders.
Article 8. Recommenders’ prize will be paid by RMB directly for domestic investments, and by RMB converted according to the foreign exchange quoteprice the day of the Government’s approval to award for foreign investments.
Article 9. At the beginning of attracting projects, the registration list of investment project will be drawn and filled in by the recommenders at the Development and Planning Committee of Jiaozuo(projects of development district, county and borough are in the local place.), and delivered to keep in the archives at the Development and Planning Committee of Jiaozuo(or development district, county, borough government) after the beneficial people’s affirmation.
Article 10. Triumphantly attracted projects will be appraised by the prize appraisement committee composed of the Personnel Bureau, the Planning Committee, the Foreign Trade and Economic Cooperation Bureau, the Financial Bureau, the Industry and Commerce Bureau of Jiaozuo etc and related experts( projects of development districts, county, borough will be appraised by the local district.), and the recommenders’ qualification will be affirmed according to the registration list of investment project. Prize criterion confirmed shall be approved by the Government uniformly.
Article 11. Prize capitals are paid by beneficial departments and financial department of beneficial districts pro rata, local financial department are responsible for the prize capitals when beneficial departments can’t be confirmed.
Article 12. The right to interpret the provisions is on the department in charge of attracting investment.
Article 13. The provisions shall put in force on May 1, 2003.
